This Privacy Policy (the “Policy”) applies to the personal information that we collect about you when you register as an exhibitor or a guest at the Montreal Comic Arts Festival (“MCAF” or the “Festival”) or when you communicate with us, including through the MCAF website (our “Website”). Please note that we do not collect any personal information simply by browsing our Website.
Consent
By providing us with personal information, such as your first and last name, mailing address, email address and phone number, through our Website or through our Festival registration forms, through our email address info@fbdm-mcaf.ca or that of a MCAF employee, in person or by telephone, you consent to our collection and storage of this information for the purpose of communicating with you and, where applicable, registering you as a Festival participant and managing the administrative aspects of your participation.
Processing
As part of your participation in the Festival, you consent to certain other personal information being collected and stored by us for the purposes of processing your participation and for statistical purposes only, including:
- any identifying information (address, phone number, etc.);
- any identification or personal document (passport, etc.);
- any other personal information of a private nature that could identify a natural person (image, etc.); and
- any other personal information concerning other individuals, such as your customers, employees, directors, officers, shareholders, or owners. You must ensure that you have obtained their prior consent for the purposes of this collection and retention.
We expressly acknowledge that we will not use your personal information for any purposes other than those described above without your consent.
Your Rights
Please note that you may contact us at any time at the address provided at the end of this Policy so that:
- we can provide you with any additional or supplementary information about how we use your personal information;
- we can provide you with a copy of the personal information we have collected from you;
- you can correct any inaccuracies in the personal information we have collected from you;
- you can withdraw your consent to the collection and processing of your personal information or otherwise delete, erase, or anonymize your personal information, subject to our rights to retain it for compliance with the law or in connection with any claims or contractual agreement;
- you can object to any processing based on legitimate interests (or those of a third party) unless our reasons for proceeding with such processing override any harm to your privacy rights; and
- you can request a transfer of your personal information to another party or third party.
Retention Period
We retain your personal information only for as long as it is reasonably necessary to fulfill the purposes for which it was collected, or as permitted or required under applicable Canadian and foreign privacy laws and regulations.
At the end of this reasonably necessary period, or if you withdraw your consent to the use of your personal information or request that it be deleted, we undertake, within a reasonable time frame taking into account technical and operational constraints, to:
- permanently destroy or erase your personal information regardless of its format or medium. We undertake, in this regard, to ensure that the destruction or erasure is carried out in a secure manner for digital media and, if applicable, by shredding for paper media; or
- anonymize it in an adequate, secure, and irreversible manner in accordance with established standards in this area, so that you cannot be identified in any way, directly or indirectly.

Your personal information may be disclosed to our advisors or third-party experts whose services we retain for the Festival or for our related activities, such as legal advisors, accountants, and administrative or technology service providers, or to the extent we deem reasonable to protect the rights or safety of a person or entity, or if required by law or regulation, in particular in response to a request from government authorities.
Security Measure
We undertake, for any period during which we hold your personal information, to implement security measures and technological means to ensure the security of your personal information stored for the purposes of providing our services, to preserve its integrity and, where applicable, to protect its confidentiality and prohibit access to it by any person who is not authorized to view it. We undertake to ensure that these measures are reasonable at all times, taking into account, in particular, the sensitivity of your information, the purpose for which it is used, its quantity, its distribution, and its medium.
Despite our commitment to security, you acknowledge and agree that we cannot guarantee that no unauthorized third party will ever gain access to your personal information, that no third party will ever overcome the security measures implemented by us or our suppliers, or that your personal information will never be used for inappropriate purposes, as these are computer systems and, despite all security measures in place, are not foolproof or 100% secure.
